- You are responsible for verifying backups and data integrity
- We are not liable for data loss arising from customer misconfiguration, third-party services, acts or omissions beyond our reasonable control, or force majeure events
Any recovery objectives or guarantees shall be set out expressly in a separate written agreement.

All intellectual property rights in the website, services, software, and related materials are owned by or licensed to BitVault.
No rights are granted to you other than those expressly stated in these Terms or in a separate written agreement.

11. Limitation of Liability
To the maximum extent permitted under Scots law:
- BitVault shall not be liable for indirect, consequential, or economic loss
- Our total aggregate liability shall not exceed the fees paid by you for the affected service in the 12 months preceding the claim
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
12. Termination
We may suspend or terminate services immediately where:
- These Terms are breached
- Payment obligations are not met
- Continued provision of services would pose legal, regulatory, or security risk
Termination does not affect accrued rights or obligations.
13. Variation
We may amend these Terms from time to time. Updated Terms will be published on our website and shall take effect from the stated “Last updated” date.
Continued use of the website or services constitutes acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising from or in connection with them are governed by and construed in accordance with the laws of Scotland.
The Scottish courts shall have exclusive jurisdiction over any dispute arising under or in connection with these Terms.
